TOPIC:    Captive Insurance: Exploring Risk Management, Tax, Estate-Planning and Other Opportunities Under New       Jersey's Captive Insurance Company Law
       
Captive insurance companies have been used as alternative risk management vehicles by large companies for decades, and, increasingly, small to mid-sized companies are also discovering the benefits of forming wholly owned captives.  In 2011, New Jersey followed the lead of several other states and authorized the formation of captive insurance companies. This presentation will explore:  How Captives Create Value for Large and Small Companies; How Properly Structured Captives Can Enhance Tax and Estate Planning; How to Form and Manage a Captive; The Experience in New Jersey So Far.

John Talley is the Chief of the Office of Captive Insurance, New Jersey Department of Banking and Insurance.  In this position, John is responsible for overseeing New Jersey’s new captive domicile and assisting those who desire to form captives in New Jersey to meet all the requirements of the new law and regulations.  Some of his varied duties include the reviewing of captive insurance company applications, providing the interpretation and guidance on the captive statute, regulations and other captive regulatory issues..  John came to the Department in July 2011 as the Assistant Chief in the Office of Captive Insurance under Crosby Sherman, the then Chief and was assigned the task of implementing the new captive insurance law signed into law on February 21, 2011. .  John received his B.S. and J.D. degrees from the University of Kansas and is admitted to practice law in Kansas, Alaska and New Hampshire (inactive in all jurisdictions).  After several years in corporate work and private practice, John has accumulated over 25 years of experience in the insurance regulatory matters in state insurance departments, with extensive knowledge in Property & Casualty, Life & Health and Surplus Lines insurance.   

Mr. Baumgartner is a Member of the firm’s Insurance Law, Insurance Litigation and Professional Liability practice groups. He is a highly experienced legal executive with a significant record of achievement in private and corporate legal practice, including corporate compliance, insurance and risk management, treasury and finance, national litigation management, mergers and acquisitions, human resources, political law and lobbying, and corporate and crisis communications. For more than 20 years, he has litigated complex insurance coverage, professional liability, environmental, and commercial disputes..  Mr. Baumgartner is a past chairman and treasurer of the operating committee of the Civil Justice Reform Group, a Fortune 100 corporate coalition dedicated to tort and legal reform. He also chaired the litigation committee of the New Jersey Corporate Counsel Association, and was instrumental in the drafting and enactment of the revised federal rules on electronic discovery. He is a member of the Claims and Litigation Management Alliance and founded its Insurance Bad Faith Committee. He also is a founding member of the Advisory Board of the New Jersey Captive Insurance Association.
 
This program had been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 1.0 hours of total CLE credit. Of these, 0 qualify as hours of credit for ethics/professionalism, and 0 qualify as hours of credit toward certification in civil trial law, criminal trial law, workers compensation law, municipal court law, and/or matrimonial law.

CFP and CPA continuing education credit will also be offered for this presentation.
